Eligibility of Foreigners for Lump Sum Social Insurance Benefits upon Employment Termination in Vietnam
Foreign nationals working within Vietnam and participating in the compulsory social insurance scheme are permitted to a lump sum payout of their social insurance benefits under specific circumstances, as stipulated by Article 9, Clause 6 of Decree No. 143/2018/ND-CP. These conditions include:
- Incomplete Contribution Periods: Employees who have reached retirement age but have contributed less than twenty years to social insurance.
- Medical Conditions: Employees diagnosed with severe, life-threatening illnesses such as cancer, paralysis, leprosy, HIV/AIDS, or other diseases recognized by the Ministry of Health.
- Residency and Retirement Eligibility: Employees eligible for retirement but who no longer reside within Vietnam.
- Contract and Licensing Termination: Employees whose labor contracts have concluded and whose practice licenses have expired without renewal.
In accordance with these provisions, foreign employees who meet any of the above criteria are entitled to receive a one-time social insurance benefit upon termination of employment.
